Estate administration and execution of wills, etc.
We handle estate administration and distribution of inheritance so that communities of heirs can be terminated and dissolved, with each heir receiving their share (in the form of liquid assets and/or tangible assets). If necessary, we take on probate duties such as execution of wills, representation of heirs, inheritance administration and liquidation. In the case of protracted inheritance situations, we advise on the rights and obligations of the persons involved and identify possible courses of action and solutions (e.g. with regard to unauthorised actions, refusal to provide or obtain information, free occupation of estate properties, dealing with problematic or inactive executors, but also with regard to lifetime gifts/donations, etc.).
Litigation and conflict resolution
If necessary, we represent our clients in all inheritance law proceedings and litigation, for example concerning the division of estates, enforcement of claims to information, contesting wills (e.g. due to dementia/incapacity, undue influence, formal problems, etc.), assertion of legacies, consideration of lifetime gifts or preservation of compulsory portion claims, etc. We obtain court judgements or, if it makes sense and circumstances permit, we also advocate for amicable solutions in court proceedings, thereby avoiding long and costly litigation.
Estate planning and lifetime provisions
If necessary, we also show how assets can be protected in a self-determined manner with regard to possible future incapacity (e.g. due to dementia) or a possible move into a care home (e.g. by setting up a power of attorney and/or appointing a preferred guardian, etc.). Furthermore, we advise on all matters relating to estate planning and assist in the implementation of the ideas and wishes formulated (e.g. by drawing up/certifying wills, marriage and inheritance contracts, powers of attorney, special and general powers of attorney, etc.).
